Foreign applicant who file a US trademark application must hire a U.S. licensed attorney. Generally, the USPTO (United States Patent and Trademark Office) recommends to hire a trademark attorney.
US TRADEMARK APPLICATION PROCESS
A federal US trademark application is filed with the USPTO. At the outset the applicant must stipulate on which basis the trademark is filed. US trademark law defines 4 different basis for the filing of a USA trademark application. These are:
- Section 1(a) – a US trademark application based on use.
- Section 1(b) – a US trademark application based on intent to use.
- Section 44 (d) and (e) – a US trademark application based on a foreign application and / or foreign registration.
- Section 66 – an International Registration which designates the USA.
